What is the Self-Employed Tax Credit?

The “SETC” (Self-Employed Tax Credit) is a colloquial term that refers to the provisional Paid Sick and Family Leave Credits for self-employed individuals introduced under the FFCRA (Families First Coronavirus Response Act).

Who is eligible for the program?

A Self-Employed Individual that filed a Schedule SE (IRS Form 1040) for 2020 or 2021, reported a positive net income, and paid self-employment taxes on those earnings, including Sole proprietors, Freelancers, Independent contractors, Gig workers, Single-member LLCs and Partners in a partnership that are subject to self-employment taxes.

What qualifies me to file?

Under the Emergency Paid Sick Leave Act (EPSLA) provision of the FFCRA, the qualified sick leave equivalent amount applies to self-employed individuals who are unable to work or telework due to:

  1. being subject to a federal, state, or local quarantine or isolation order due to COVID-19,

  2. being advised by a healthcare provider to self-quarantine due to COVID-19, or

  3. experiencing COVID-19-related symptoms and seeking a medical diagnosis.

Under the expanded Family and Medical Leave Act (FMLA) provision of the FFCRA, the qualified family leave equivalent amount applies to self-employed individuals who are unable to work or telework due to:

  1. caring for an individual who is subject to a quarantine or isolation order related to COVID-19, or

  2. caring for a child if their school is closed or childcare provider is unavailable due to COVID-19.

How much of a tax credit can I expect to receive?

There are a few factors that go into calculating your tax credit refund amount. For example:

  1. Your net income from your schedule C on your 2019, 2020 and 2021 tax returns.

  2. How many days you were out sick or told to quarantine with Covid-19

  3. How long you might have cared for a loved one affected by Covid-19.

  4. How long any schools or daycare centers were closed (and you were forced to care for a minor child during the closings.

What if I was Self-employed but also took a Paycheck (W2)?

You will not receive the full SETC amount if you already received sick or family leave in 2020 or 2021 through an employer. Your SETC portion will be reduced by the wages you received.

Can I still qualify if I already filed my taxes for 2020 & 2021?

Yes. We will just need to file an amendment to your tax return, which is standard.

Is the SETC tax credit based on gross self-employed income or net self-employed income?

In order to qualify for the self-employed tax credit you MUST have a positive NET (after deductions) self-employed income for either 2019, 2020 or 2021.

My spouse is also Self-Employed. Can we both file?

Yes, if both of you are self-employed, you could each qualify for up to the maximum amount of $32,220 for a maximum total of $64,440.

Are you eligible for the tax credit if you and/or your child don’t have health insurance?

Yes. Your eligibility for the Self-Employed Tax Credit (SETC)  does not take health insurance coverage into consideration.

What dates are eligible for SETC tax credits?

The SETC covers the days you were unable to perform self-employment work from April 1, 2020 – September 30, 2021.

Is there a deadline to apply?

Yes, two deadlines apply to the amended tax returns required for your claim. The deadline for your 2020 amended tax return is April 15, 2024. This deadline applies to the period between April 1, 2020, and December 31, 2020, and accounts for $15,110 of the SETC value. The deadline for your 2021 amended tax return is April 15, 2025. This deadline applies to the period between January 1, 2021, and September 30, 2021, and accounts for $17,110 of the SETC value.

What documentation do I need to provide?

For the most part, we only require your 2019, 2020, and 2021 tax returns, including related Schedules and a copy of your driver’s license for identification. We may also require IDs of your spouse and supporting documentation regarding school closures, vaccination and positive COVID-19 tests.

Is the SETC Taxable?

No. The SETC it is not taxable!

How much do you charge?

The initial analysis to determine if you are eligibility is completely free.
We charge a reasonable consultation fee. A sliding scale fee based on your level of eligibility. This is broken down in 4 monthly installments with the initial installment due upon signing the agreement. We provide a 10% discount to clients that choose to pay in full upfront. We accept credit cards, Paypal, Zelle and bank withdrawals.

Does filing for SETC tax credits impact filing my 2023 income taxes?

Filing for the SETC tax credit will not impact filing your 2023 income taxes. To receive SETC tax credits, our team of CPAs will amend the taxes you already filed for 2020 and/or 2021.

What if I have an IRS debt or a Treasury Off-set (State Tax Debt, Child Support, etc.) Will the IRS take my money?

You’ll need a $0 balance with the IRS to receive a check. That means any outstanding or past-due taxes or Treasury Offset must be paid off first, and you’ll receive whatever is left over (if anything).

How long does it take to get my SETC Credit?

It can take up to three weeks for the IRS to acknowledge their acceptance of your SETC claim and 20 weeks for the IRS to process your SETC claim and issue your checks or direct deposit. However, clients typically receive their refund sooner. Clients who opt for direct deposit may receive their refund even sooner.

What if I didn't have positive tax earnings in 2020 or 2021. Can I still get SETC?

If you did not have positive earnings in 2020 because of Covid-19 restrictions you may elect to use your 2019 net income if that year has a positive self-employed income, and if you did not have positive earnings in 2021 because of Covid-19 restrictions, you may elect to use your 2020 net income if that year has a positive self-employed income.
